Sydney – The Supreme Court of New South Wales has delivered a Judgment in favour of an Owners’ Corporation, represented by Hazan Hollander, against a builder for shoddy building work.
The development of 27 townhouses in the Eastern Suburbs of Sydney was infected with building defects. Hazan Hollander took the fight to the Supreme Court, and has now secured a judgment for the owners for more than $5 million, plus costs.
In delivering his Judgment, Supreme Court Judge, John Sackar, said to Senior Lawyer Advocate, Yves Hazan who appeared in the case:
“Mr Hazan, let me simply say first, thank you very much for presenting the material so clearly.
Secondly, I am satisfied that the level of defects proven by the various experts who have obvious qualifications to do so.
I am also satisfied with the quantification at the amount … of the order you propose.”
Senior Lawyer, Peter Whitehead, who was the Solicitor acting on the case, has hailed the win as an emphatic victory against shoddy building work, and has said: “it is very satisfying to bring builders to account for the grief they cause home owners when delivering defective works”.
