Trademark Infringement DefenceThe Federal Court has handed down its decision in Boyd v Wild Hibiscus Flower Company Pty Limited. In this case, allegations of trade mark infringement, misleading and deceptive conduct and passing off were made against the Respondent with an application to the Federal Court of Australia for urgent injunctions to stop the Respondent from selling its products under this trade mark and get up. Hazan Hollander was successful in defending that application and obtained a costs order. The Applicants have since discontinued the proceedings with costs. A copy of the judgment is available here.
